When Open AI models carry out a cyberattack, who is responsible? This is a new question for policymakers, who haven’t had to grapple with something like this before.
A recent article on Fox26 outlines how two AI models recently left their testing environments and launched an attack on another platform. The liability for such occasions is in question because there aren’t specific legal guidelines in place. But even so, Co-Director Ryan Calo does not believe a criminal case would be likely to succeed.
“The company or individual would have to be at least reckless,” he said, explaining they would “be substantially certain the crime would occur and build or prompt the system anyway.”
Another layer is that while there currently is no legal precedent, that will change as soon as one case comes forward.
Proving that a similar incident could have been anticipated “shouldn’t be so hard now that it’s begun to happen,” he said.
