TPL Co-Director Ryan Calo participates in the ongoing conversation about the harms that are present within privacy lawsuits. In the EU and the United States, privacy and security harms include security breaches, misuse of individual data, and algorithmic errors. In this article, many privacy lawsuits do not provide compensation for victims, especially based on emotional or intangible harms. According to Calo, compensation seems to be provided only when the consumer is monetarily harmed. Currently, U.S. legislation concerning privacy harms cannot compensate consumers unless their wallet is hurt.
